Mary W. Maxwell, Trump’s Lawsuit against Twitter Is a Masterpiece. It Will Save Us!

This lawsuit is superb.  It is brilliant. It will solve the problem of Free Speech.  Thank you, Twitter, for making such an egregious error in shutting down the communication of a sitting president of the United States.  Thank you, Jack Dorsey, for buckling under pressure from (then) Senator Kamala Harris, Senator Richard Blumental, Nancy What’s Her Name, and the CDC, such as to make possible this searing plaint to the courts. Thank you, CDC, for being your usual awful self, harming us citizens to the max.

Gotcha. You are done, the lot of you.

I am a conservative Republican. You may be surprised to hear that I thought Donald Trump was a terrible president. The “Muslim ban” floored me, simply floored me. I never had the sense that the president knew, or cared, what was in the Constitution. I sued him (Maxwell v Trump) in 2017 over his threat to nuke North Korea. His moving of the US Embassy in Israel from Tel Aviv to Jerusalem was a sacrilege to people of all three Abrahamic religions. It was jaw dropping that he chose John Bolton for National Security. I am currently in appeal (Maxwell v Secretary of Defense) against mandatory vaccination.

I ran against Trump in the 2020 New Hampshire primary for the Republican presidential nomination. I was glad that Trump didn’t get a second term, though I find Biden’s administration horrific and surreal. I know for sure that the election was stolen and that the “rioting” at the Capitol, on January 6, 2021, was done by agents provocateurs. And by the way, I hate the partisanship that has become childish on both sides. This “Westminsterization” of our Congress has been making representative government a joke.

It’s a Wow

That said, Trump v Twitter is a genuine constitutional solution to many problems. Even if it never flies – though I expect it will fly – the accomplishment is already there. Below, I will print the whole thing, or almost all of its 9,000 words, skipping a few items that were repetitive. I have bolded the many, many excellent points made by Trump’s all-new legal team. They should get, I dare say they will get, medals of honor. I offer them the Maxwell litigation salute.

Here is the gist of the case, in Nine Points:

Point #1.  As everybody knows, Twitter chopped off the communication between (then) President Donald J Trump and his 88.9 million Twitter followers.

Point #2.  They did it by way of Section 230 of the Communications Decency Act, 1996,  that protects from liability the social media companies that may censor someone unconstitutionally.

Point #3.  This is a new one on me – social media companies  (e.g., Twitter and Facebook) were furnished with this trick, in Section 230, IN ORDER TO MAKE POLITICAL CENSORSHIP HAPPEN. (I faint!)

Point #4. Members of Congress (including Adam Schiff of impeachment fame, oh please) bullied Jack Dorsey to do the de-platforming, against his better judgement.  They threatened him with all sorts of loss of business and personal embarrassment – as is their wont.

Point #5. “Legislators” made known their desire to prevent publication of “COVID-19 “misinformation,” including the lack of safety and efficacy of hydroxychloroquine and the use of face masks,” and Questioning the integrity and results of the 2020 Presidential election.” 

Dear God.

CDC is mentioned in the suit, as to its control over Americans’ communication

The CDC (I retch) was no innocent bystander. At Paragraph 77, please find:

“Point #6: The CDC has publicly stated that it works with “social media partners,” including Twitter, to “curb the spread of vaccine misinformation.” In a document dated October 11, 2019, the CDC expressly stated that it was “engaging . . . partners” to “contain the spread of [vaccine] misinformation” and specifically states that the CDC would “work with social media companies” to that end.”

There is real constitutional content here, as in the making of culture, e.g., in Paragraph 61 of the lawsuit we read:

“Point #7. By banning Plaintiff, Defendants have made it more difficult to communicate directly with the American public. Our national discourse is becoming immeasurably more altered and one-sided on race, medicine, the election process, the economy, immigration, etc.”

Blessed, blessed relief just from seeing that in print – in a Court of Law. And this precedential beauty at Paragraph 114:

“Point #8. In censoring the specific speech at issue in this lawsuit and in deplatforming Plaintiff, Defendants were acting in concert with federal officials, including officials at the CDC and on the Biden transition team.  As such, Defendants’ censorship activities amount to state action.” 

I have never seen that argument before. Where have I been all my life?

You knew I’d save the best for last, concerning Mr Facemask himself.  I will try to see that arrests, by citizen’s-arrest if necessary, follow. (Oh, you think you can get me for incitement? Oh yeah? Try it! Deplatform me!)  The corpus-delecti-to-be is at Paragraph 78:

“Point #9.  Dorsey and Twitter acted to censor other medical opinions that did not uphold that narrative of Dr. Fauci and the CDC, which took on both a political and medical nature, given the interconnection between government policy and pending and science.”

Are we thinking a 18 USC 1983 prosecution?

Hugs and kisses for the US Constitution. You rock, James Madison! You shine, George Mason! Luv ya, all.

Oops, I forgot to say that Trump is not the only plaintiff.  Also in the case are the American Conservative Union, a single litigant named Linda Cuadros, and what is called the Putative Class, a potential huge number of people (maybe some from Australia? I know at least one dual US-Oz citizen) whose accounts were suppressed for not meeting community standards.

Please, Readers, rejoice with me.  This case is unanswerable. It is filed at the District Court of Florida. The judge has only to agree that an injunction is warranted. Lucky him or her. His or Her Honor will become famous for SAVING AMERICA AND SAVING THE WORLD.

Our troubles are over.  Amen.

    1. I hope Trump doesn’t get Judge Rosenberg to handle his case, the same judge who preside over James Tracy’s show trial in which he was dismissed for exposing Sandy Hook. Let’s face it–there are a lot of corrupt judges in South Florida, just as there are all over the US. (Witness the 61 straight electoral-fraud lawsuits filed on behalf of Trump that were summarily dismissed.) But, if for some reason the case is not dismissed, then there could be some powerful evidence revealed.

      I don’t like the Trump-bashing in this article. True, Trump made some unfortunate decisions, but he needed to make some of the them to survive politically when virtually the entire establishment was against him and some were made because he had no support from those working for him in key positions. One of those was his ramping-up of vaccine development. However, he always maintained that vaccination should be completely voluntary and not coerced–contrary to what is happening under the current administration.

  7. Complain about President Trump all you want, but US elections come down to a choice between just two people. President Trump is certainly not without faults, but he was honestly elected and did a good job overall. He certainly was a better choice than Hillary.
    In 2020 President Trump was the clear choice of the people while demented incoherent Biden was selected with counterfeit ballots, and machine swapped votes.
    I would rather have a president that was elected by the citizens than one like Biden who is simply a puppet dictator installed with immense help from the Deep State which now includes all of Big Tech.

    In 1604, a group of leading UK politicians, businessmen, merchants, manufacturers and bankers, met and formed a corporation called the Virginia Company in anticipation of the imminent influx of white Europeans into the North American continent. It had two branches, the London Company and the Plymouth or New England Company.

    The former was responsible for the first permanent colony in America at Jamestown on May 14th 1607 and the latter were the so-called ‘Pilgrim Fathers’ who arrived at Cape Cod in the ship the Mayflower, in November 1620, and went on to land in Plymouth Harbor on December 21st.

    The Virginia Company lands were granted to the colonies under a Deed of Trust (on lease) and therefore they could not claim ownership of the land. They could pass on the perpetual use of the land to their heirs or sell the perpetual use, but they could never own it. Ownership was retained by the British Crown.

    After the original American colonies won their ‘independence’ and an ‘independent’ country was formed after 1783, the Virginia Company simply changed its name to… the United States of America.

    You see there are two USAs, or rather a USA and a usA. The united states of America with a lower case ‘u’ and ‘s’ are the lands of the various states still owned by the British Crown as the head of the old Virginia Company.

    Then there is the United States of America, capital ‘U’ and ‘S’, which is the 68 square miles of land west of the Potomac River on which is built the federal capital, Washington DC and the District of Columbia.

    The United States of America is not a country, it is a corporation owned by the same bloodlines who owned the Virginia Company, because the USA is the Virginia Company!

    When Americans agree to have a social security number the citizens of the united states surrender their sovereignty and agree to become franchisees of the United States (the Virginia Company of the British Crown). Hense the ALL CAPS in your name correspondence from the government.and the gold braid around the flags in Federal Courts, etc.

  10. Nothing is more satisfying than winning a law suit when given a snow ball’s chance in hell of prevailing. Especially when acting as your own attorney. The court system has brain washed us into thinking we are lost without paying an attorney $300 an hour. I proved that’s a big lie. If you can read and write and follow directions, filing a law suit is not that complicated. However, collecting when you win is like trying to divide Avagadro’s Number by infinity, in your head. That’s the tough part people falter on. I was relentless in my quest and collected triple damages. What was more satisfying than collecting triple? Not paying an attorney a DIME!

  11. Well I find it fascinating that Fetzer’s website is again the only one I can interact with… on a limited bandwidth hotspot in the hinterlands of the Dakota territories. I am reading this lawsuit article and pondering our current prospects for the survival of this country economically and spiritually. The United Airlines computers went off line on the same day the Powers That Be were conducting a Cyber 911 simulation called Cyber Polygon. Every company is begging for employees with no takers ! There was one lady waiting on 50 travelers at the airport waiting for food. I’m starting to be really concerned what rocks the deep state will toss in our gears next.

    As I blazed across the great plains toward the Black Hills today, I kept searching the radio dial for music but also got some unwanted fake news… the new delta variant of the Kung Flu is the new “sky is falling” static in the attic. Missouri is making noise about new mask rules indoors, AGAIN! They blew smoke up my ass about a third booster shot. I smell another shutdown coming and I know that Colorado Governor Pole-Up-His-Ass will go along with it. But you know who won’t? The only Governor with any real balls… Kristi Noem of South Dakota.

    My best pal has had a severe stomach ailment lasting six weeks and counting… after he got his second Kung Flu shot. What an idiot!     I had to fly from Rapid City down to Denver on Friday to pick up my car and bring it back. It was the first time I have flown in many years. It was surreal nightmare twilight zone episode. I was molested again by TSA because I would not get in the Naked Body Radiator Device. It’s not gay if it’s TSA! They could eliminate all opposition to it if they had hot chicks grabbing your balls! But no it’s some pervert for hire again. United Airlines has gone off the rails into the abyss of the shittiest travel company still afloat. My girlfriend paid extra so we could sit together and they called me up to the counter, said there was a problem with my ticket but it was a lie. They changed my seat assignment and I didn’t notice. They charged extra for picking our seats and then separated us. Then they delayed the departure forever because they were overbooked and no one would would bump themselves. Suddenly the United Airlines computers went off line. Denver disappeared off the gate sign and was replaced with a different city. No explanation, no announcement… customers were left in the dark and a sense of chaos came over the restless and bewildered travelers… on the same day the Powers That Be were conducting a Cyber 911 simulation called Cyber Polygon. Sure it was a coincidence.

    Then United switched their gates without being able to change the electronic signs. Many Denver people were hesitant to go down a gate with Minneapolis over it. All 150 people had to have their names verbally spoke into a walkie talkie to check us in. It felt like we were back to the 1940s state of aviation. I get on the plane and flight attendant was so obese no one could pass her in the aisle. It was like a Saturday Night Live episode of the “total bastard airlines” skit where the staff is so horrible to their customers, they have to be escorted by armed guards to their cars after work. I tried to get to the bathroom and she turned sideways and blocked the aisle even more. There was was like four inches to get by. I almost got wedged and trapped against her. Then she scolded me for dropping my face mask and said “there was zero tolerance” and she had had a dozen people deplaned because of masks. Her sense of power was wielded like a club.

    It takes 8 hours to make the drive back to Colorado. And it took over 9 hours to fly back and take the shuttle because United made us miss the ground transport. The Pilot told us to go to carousel 10 for our luggage. We get there and wait and wait. No luggage, no announcement. Then a fellow passenger said go to carousel 19. That’s a half mile away at DIA. It was the final nail in the coffin of making our shuttle. I might never fly again, but I said that last time. They have taken down the spooky murals depicting the end of the world. And in their place erected signs picturing aliens and cats with tin foil hats that mock us for noticing things like sculptures of gargoyles coming out of suitcases and a capstone plaque mounted to Death’s Harvester shaped bracket with “New World Airport Commission” and the Mason’s square and compass insignia.
